1. Information We Collect Our primary goal in collecting personal information from you is to provide you with a smooth, efficient, and personalized experience while using our services. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience easier and quicker.

To fully use our services, we ask that you sign up as a member via our Registration system, where you will be required to provide us with your contact information (such as your e-mail address) and other information. We automatically track certain information about you based upon your behaviour on our site. We use this information for internal research on our users' demographics, interests, and behaviour to better understand and serve our users. This information is compiled and analysed on an aggregated basis. You are not personally targeted.

Using server log files, we analyze trends, track users' movement, and gather broad demographic information for aggregate use. This information may include the URL that referred you to our site (whether this URL is on our site or not), which URL you next go to (whether this URL is on our site or not), what browser and operating system you are using, your IP address, and your general geographic location.

In addition, cookies are used on our site to maintain login information in order to make your browsing experience smoother and more enjoyable. Cookies are stored on your hard drive, not on our site. Most cookies are "session cookies," meaning that they are automatically deleted at the end of a session. The other type of cookie we use is a 'persistent' cookie. This stays on your hard drive and we use this to automatically identify who you are. We use this cookie so that you do not need to log in manually every time you visit the site if you are a registered user. The cookie itself contains no personally identifiable information. It only passes an ID to our server which allows us to tie the cookie to your account information. You are always free to decline or delete our cookies if your browser permits, although in that case you will not be able to use certain features on our site. For example, if you disable cookies, you will need to log in manually each time you visit the site as we cannot use a cookie to remember who you are.

We use Google's AdSense service to serve ads which generate the revenue necessary to keep the site free. Google sometimes uses a cookie to display more relevant ads, though absolutely no personally identifiable information is transmitted back to Google. You can easily opt out of Google's interest-based ad cookie on this page.

Surveys & Contests From time-to-time our site may request information from users via surveys, contests or for a particular service (e.g. newsletter). Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information and miscellaneous supplementary details on your interests, opinions and preferences. We will use the contact information to notify winners. We will not publish winners' details on the site though, in accordance with United States Contest and Lottery law, we will provide winners' names and general geographic locations (e.g. state of residence) upon request. In the event that the Survey or Contest is sponsored by a 3rd party, your contact information may be shared with that 3rd party to provide you with your prize, reward, or other benefit.

Payment Processing Some aspects of iBandstand.com require paid-subscription or purchase. We use Paypal to process all payments to iBandstand. We do not have access to credit card and other financial information given to Paypal. To view Paypal's privacy policy, click here.

2. Our Use of Your Information We use personally identifiable information about you to statistically analyze site usage, to improve our content and product offerings and to customize our site's content, layout, and services. We believe these uses allow us to improve our site and better tailor it to meet our users' needs.

We use your email address to send you site notifications, newsletters, and other communications that you have specifically requested. All email communication is strictly Opt-In.

We use information in the file we maintain about you, as well as other information we obtain from your current and past activities on the Site, to resolve any disputes, troubleshoot problems and enforce our User Agreement. At times, we may investigate multiple users to identify problems or resolve disputes. On rare occasions, we may evaluate your information to look for users using multiple User IDs or alias.

In the event of suspected violation of our Terms of Service, iBandstand may review all of a user's posted content, including on-site messages sent to other users.

3. Our Disclosure of Your Information Unfortunately, due to the state of the United States regulatory environment, we cannot ensure that your private communications and account information will not be disclosed in ways not otherwise described in this Privacy Policy.

For example, we may be compelled to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. By using our site, you agree to allow us to disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us to legal liability.

We will never rent or sell personally identifiable information about you to any third party.

Advertisers We disclose usage trends and information in aggregate to advertisers and potential advertisers. However, in these situations, we do not disclose to these entities any information that could be used to personally identify you.

Community Throughout the Site, you are identified by your User ID, which is thereby disclosed to other users and third parties. Your User ID can be used to identify you and your activities throughout the Site. Other people can see your postings on the Site. We also provide others a number of ways to allow other users to find more out about you and your site activities if you give them permission to access this information. Please be aware that if you post personal information online that is accessible to the public, you risk receiving unsolicited messages from other parties in return. iBandstand.com cannot be liable for any such communications. However, all emails and messages are handled through our website. iBandstand does not disclose your email address to other users.

Legal Requests iBandstand.com cooperates with law enforcement inquiries and other third parties to enforce laws, intellectual property and other rights. Local, and international law enforcement agents can request and may be given your personally identifiable information.

4. Opt-Out of Email Communications If at any point you wish to cancel your subscription to our newsletters or to stop receiving site notifications, click the "Unsubscribe" link at the bottom of the message.

5. Public Discussion If you choose to post messages in our forums, comment in other areas of the site (e.g. comments on songs in the Music section of the site), or send messages to other users, we will store such information in your personal file. This is so that we can see what contributions you have made to the site and identify problems or resolve disputes.

Where you make such comments or forum posts, your User ID will also be given on the site allowing other users to click on it to find out more about you. Your User ID and Public Profile are always publically available information. We track which forum messages individual site users read. This is in order to help us understand which content that user is most interested in. We use this intelligence to help personalize the site to match the interests of our users.

6. "Tell a friend" services iBandstand.com occasionally offers a service whereby you can e-mail site content (for example, a particular forum post) to a friend or colleague. This will involve entering the e-mail address of your friend. We do not use the e-mail addresses you enter for any purpose other than to send your e-mail. We do not store, rent or sell these e-mail addresses.

7. Your Password Except as specifically permitted by this section, you may not disclose your iBandstand.com password to any third parties nor share it with any third parties. If you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password by visiting the preferences page on the Site.

When submitted to iBandstand, your password is encrypted in a way that it cannot be decrypted. It is stored in our database in its encrypted form. To verify login credentials, the password you submit is encrypted and compared to the entry in our database. iBandstand does not have access to your password and cannot recover it. You must reset it by visiting the Forgotten Password form.

8. Reviewing and Changing Your Personally Identifiable Information You can at any time review and change the information you submitted during registration by visiting the preferences area of the Backstage User Portal.

You must promptly update your information if it changes. Once posted, you cannot change or remove any public postings made in our forums or other message areas.

You can at any time request that your account information be removed from our database. Please contact us if you would like your personal information removed. We will retain in our files information you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems and enforce our User Agreement. Further, such prior information is never completely removed from our databases due to technical constraints and the fact that we back up our systems. Therefore, you should not expect that all of your personally identifiable information will be completely removed from our databases in response to removal requests.

9. Other Information Collectors Except as otherwise expressly discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, whether they are other members of the Site or other sites throughout the Internet, different rules may apply to their use or disclosure of the personal information you disclose to them.

10. Data Security While iBandstand endeavors to safeguard the confidentiality of your personal information, you should be aware that transmissions to and from our servers are not encrypted. Despite that, as mentioned in Section 7, passwords stored on our server are encrypted in a form that cannot be decrypted.

11. Changes to Privacy Policy If we are going to use your personally identifiable information in a manner different from that stated at the time of collection we will notify you via email, prior to making such changes. You will be able to decline such use by forfeiting your iBandstand account. In addition, material changes to our privacy practices that do not affect user information already stored in our database will be accompanied by prominent notice prior to the changes going into affect. In some cases, users who have opted to receive emails from us will be notified by that means.

12. Downloadable Software Disclaimer This privacy policy covers only information that is collected through this Web site, and does not include information that may be collected through software downloaded from the site.
